Virginia Board Denies Opioid-Fraud Dentist's License Reinstatement

The Virginia Board of Dentistry denied Dr. Gary Hartman's request to reinstate his dental license, despite three years of documented sobriety and completion of recovery programs following his conviction for leading an opioid fraud scheme.

Hartman operated an opioid fraud operation from 2014 to 2018, resulting in a federal conviction and a 100-month prison sentence. After serving his term, he applied for license reinstatement in December 2024, presenting evidence of sobriety through drug screenings and participation in recovery programs.

The board was unmoved. While Hartman retains the right to appeal, the denial signals that state boards are holding firm on the principle that certain violations — particularly those involving controlled substance fraud — carry permanent professional consequences regardless of rehabilitation efforts.

For the dental profession, the case reinforces that opioid-related fraud occupies a distinct category in board enforcement. The opioid crisis has led regulators to adopt a zero-tolerance posture that treats prescribing fraud as a public health violation, not merely a licensing infraction.
